Terms of service
This is an English translation for convenience. The Spanish version (Condiciones de contratación) is the legally binding one and prevails in case of any discrepancy.
1. Who provides the service
Jose Soriano Castro (WebIntacta), tax ID (NIF) 50508565J, with address at Calle Espronceda, 59, 03440 Ibi (Alicante), España. Contact: info@webintacta.com. More details in the legal notice.
2. Services and prices
The services, what each one includes and its price are listed on the pricing page. Prices in euros are excluding VAT. Prices are published without VAT: Spanish VAT (21%) is added for customers in Spain, EU businesses with a valid VAT number are invoiced under the reverse-charge rule, and customers outside the EU are normally invoiced without Spanish VAT. The taxes that apply under current law, given the client's country and status, are stated in the order confirmation before payment. Clients outside the EU are charged the US-dollar prices published on the pricing page.
Anything without a fixed price (custom websites, other CMSs, fixes outside a plan) is quoted in writing before work starts, and the accepted quote does not change unless you extend the job.
3. How to order
- You send me a request through the website (support form), or pay through a payment link if one is available for that service.
- I confirm in writing the scope, the total price and when I can start. I do not promise response times: I tell you when I can do it before you pay.
- With your acceptance and the payment (or the first installment, for maintenance), the contract is concluded.
- When I finish, I deliver the report or the summary of what was done.
Urgency is not a service of its own but an add-on to another service, at a published extra price: “Priority” is added to a cleanup and the “Priority add-on” to a maintenance plan. Neither is sold on its own. Both mean priority: your work goes ahead of the rest of my queue, on weekends too if needed. They are not a guarantee of response or resolution time.
4. Payment
By card through Stripe's secure payment page, or by bank transfer. Before paying by card you tick a box accepting these terms and asking me to start right away (see section 9). One-off services are paid when ordered; maintenance is paid monthly or yearly (the annual payment equals 10 months), in advance. You will receive an invoice for each payment.
5. What I need from you
- That the website is yours or that you have its owner's authorization to hire me for the work.
- The necessary access (connector, administrator, hosting) when the service requires it. When a cleanup is finished, we change the passwords.
- That you tell me about changes made by you or by third parties to the website while I am working on it.
6. Security report
The report describes the state of the website at the time of the analysis, with the evidence for each finding, and we go through it together by email or chat (in Spanish, also on a call). If within 30 days of delivery you order a cleanup or a maintenance plan for that website, the report's price is fully deducted. A report reduces risk, but it does not guarantee that a website is invulnerable.
7. Cleanup and 90-day guarantee
The cleanup includes removing the malicious code, backdoors, and the attacker's users and scheduled tasks, fixing the flaw the attacker got in through when it can be identified, and requesting a review from Google if there was a warning. I always work on a prior backup.
Guarantee: if within 90 days of delivery the website shows the same infection again, I clean it again at no cost. The guarantee does not cover infections from new causes after delivery (for example, installing a pirated or vulnerable plugin or module, or a password leaked afterwards), nor changes made by third parties without coordinating them with me.
If during the diagnosis I see that the website cannot be recovered (for example, because the content is missing and there are no backups), I tell you before going on and you only pay for the work done up to that point, or nothing if we agreed so at the start.
8. Maintenance
- No lock-in: you can cancel whenever you like; it stops renewing and the service continues until the end of the period already paid. With annual payment, early cancellation does not entitle you to a refund of the unused months, except as provided for consumers in section 9.
- Included cleanup: the cleanup of each plan (one a year in Business website; included in Online store) becomes available from the third month of continuous subscription.
- The hours of work included in a plan do not carry over from one month to the next.
- I may change maintenance prices with at least 30 days' notice; if you do not agree, you can cancel before then.
9. Right of withdrawal (consumers)
If you contract as a consumer (for purposes outside a business or professional activity), you have the right to withdraw from the contract within 14 calendar days of its conclusion, without giving any reason, under articles 102 et seq. of the consolidated text of the Spanish General Law for the Protection of Consumers and Users (Royal Legislative Decree 1/2007, TRLGDCU). To exercise it, send me an unequivocal statement (for example, an email to info@webintacta.com) before the period ends. I will refund what you paid within 14 days at most, using the same means of payment.
As these are services, if you expressly ask me to start before the 14 days are over (the usual case with a hacked website) and then withdraw, you will have to pay the proportional part of the work already done (art. 108.3). And if the service has already been fully performed with your express consent and your acknowledgment that in that case you lose the right of withdrawal, you can no longer exercise it (art. 103.a). Before starting within that period, I will ask you for that confirmation in writing; if you pay by card on the website, you give it by ticking the terms box.
If you contract as a business or professional, the right of withdrawal does not apply.
Model withdrawal form (only fill it in and send it to me if you wish to withdraw; an email with the same content is also fine):
To Jose Soriano Castro (WebIntacta), Calle Espronceda, 59, 03440 Ibi (Alicante), España, info@webintacta.com:
I hereby give notice that I withdraw from my contract for the provision of the following service: [service].
Ordered on: [date] · Name of consumer: [name] · Address of consumer: [address]
Signature of consumer (only if this form is notified on paper) · Date: [date]
10. Liability
I work with professional diligence and with prior backups, but absolute security does not exist: no analysis, cleanup or maintenance guarantees that a website will not be attacked again. Except in cases of willful misconduct or gross negligence, and without prejudice to the rights the law grants consumers, my liability for a service is limited to the amount paid for it. I am not liable for damage caused by third parties (attackers, hosting providers, authors of plugins or modules) or for changes I did not make.
11. Confidentiality and data
I treat everything I see of your website as confidential. If during the work I have access to your customers' personal data, I act as a data processor only for that job (art. 28 GDPR); if you need it, we sign the corresponding data processing agreement. Everything else is in the privacy policy.
12. Intellectual property of the tools
The connector, the agent, the inventory scripts and the other tools I give you to analyze your website, as well as the analysis method, the panel and the report format, are my own work and are protected by the Spanish Intellectual Property Law (Ley de Propiedad Intelectual). I grant you a personal, non-exclusive and non-transferable right of use, limited to your website and to the duration of the service ordered.
You may not copy, modify, redistribute, sell or transfer them to third parties, nor decompile or reverse-engineer them, except to the extent the law expressly allows. Every copy I deliver is identified. When the service ends, you must uninstall the connector and delete the tools I have sent you. The report is for your use: you can show it to your team, your provider or whoever needs it, but you may not publish it or resell it as your own.
This clause does not apply to the WordPress plugin, which is distributed under its own license (GPL), nor does it limit the rights the law grants consumers.
13. Governing law and complaints
These terms are governed by Spanish law. If you have a complaint, write to me first: almost everything gets sorted out by talking. Consumers may also turn to the consumer services of their autonomous community (region of Spain) and to the courts of their place of residence.
